Purchase and delivery policy

Terms and Conditions of Sales

Du Chanvre reserves the right to limit the quantities available for the online purchase of its Products and services offered.

Du Chanvre also reserves the right to cancel any order, for whatever reason, in which case the client shall be notified by email or phone and a full refund shall be made using the original method of payment.

The client agrees to submit true information when ordering online, including accurate email, billing address, delivery address, information related to the method of payment, as well as accurate personal information.

 

Payment Method

Payment for online purchases shall be made through the following credit cards, either Visa or MasterCard, or through a PayPal account.

For payment by credit card, you will be able to enter your banking information when placing your order. The applicable amount of your transaction will be temporarily held from your credit card and will be debited once the Products have been shipped. Du Chanvre reserves the right to verify the validity of the credit card, its degree of creditworthiness in relation to the value of the order, as well as the address of the person placing the order. The results of such verification may justify our refusal to act on your order.

For payments via the PayPal platform, Du Chanvre reserves the right to verify that your PayPal account is valid, that the funds are sufficient to cover the purchase and that the billing address is correct.

 

Order Processing

All orders will be processed subject to approval of payment, availability of Products and any other agreement with customer service. The offering of a Product or service on the Site at any given time does not imply or guarantee the availability of that Product or service at all times.

The client acknowledges that the Products marketed by Du Chanvre comply with trade tolerances with regard to the colour, shape, analysis, hardness and size of the Products.

Du Chanvre reserves the right to stop the sale of any Product at any time. Du Chanvre reserves the right to change these terms and conditions from time to time without notice. The version of the terms and conditions that shall apply to your order shall be the one displayed on the Site when you place your order.

Once you have placed your order on the Site, you will receive a confirmation email. If Du Chanvre is unable to fulfill your order, we will notify you as soon as possible. If Du Chanvre has already received payment for your order, we will refund you using the same payment method you used if we are unable to fulfill your order.

 

Delivery

Delivery of the Products shall be made within a maximum period of THIRTY (30) days by standard or express mail from a company operating in the parcel delivery service in Canada only. The delivery company selected by Du Chanvre shall therefore be responsible for transport delays as well as delivery delays as soon as Du Chanvre will have handed over the client’s order to the latter for delivery. Therefore, Du Chanvre cannot be held responsible for delays in delivery which are attributable to the selected delivery company.

The delivery costs are the responsibility of the client and shall vary according to the weight of the Products ordered, which shall be calculated from Du Chanvre’s warehouse, the destination of each order as well as the speed of delivery requested. Orders destined for outside Quebec will obviously be more expensive.

Du Chanvre strives to ship the Products as quickly as possible in the order in which the orders were placed. Du Chanvre’s objective is to deliver an order, following confirmation of the order by Du Chanvre and unless otherwise agreed between Du Chanvre and the client, within TWENTY (20) to THIRTY (30) business days for orders delivered in Quebec and within THIRTY (30) to FORTY (40) business days for orders delivered elsewhere in Canada. Deliveries to remote areas may take a few extra days. Although Du Chanvre will endeavour to deliver the Products within the stated time limits, delivery may be delayed by unforeseen circumstances that are beyond Du Chanvre’s control.

All orders shall be accepted, subject to Du Chanvre’s ability to ship, and are subject to additional delays in the event of reasons beyond Du Chanvre’s control. Du Chanvre shall not be responsible for additional delivery delays in case of force majeure.

No delivery or pick-up charges shall apply if the order is picked up by the client at their convenience.

 

Acceptation

The Products shall be deemed to have been accepted by the client if they are not rejected within 2 business days.

 

Price

All prices on the Site are displayed in Canadian dollars. Prices and Products are subject to change without notice. The prices displayed on the Site do not include applicable sales taxes (GST and QST). Sales taxes shall be calculated when the order is finalized.

 

No Liability of Du Chanvre 

Du Chanvre cannot be held responsible for errors made by the client, in particular during the transmission of the client’s information at the time of sending an order or for delays in delivery or the inability to deliver the Products ordered as a result of such errors.

YOU ALSO UNDERSTAND AND AGREE THAT DU CHANVRE CANNOT BE HELD RESPONSIBLE FOR DIRECT OR INDIRECT DAMAGE OF ANY KIND. OUR MAXIMUM LIABILITY TO YOU FOR ANY LOSS OR DAMAGE ARISING FROM YOUR ORDER ON THE SITE SHALL BE LIMITED TO THE TOTAL PRICE OF YOUR ORDER.

 

Jurisdiction

This Purchase and Delivery Policy, as well as the use of the Site by the client, are governed by the laws of the province of Quebec and the laws of Canada applicable therein.

Return policy

Terms and Conditions for Return

Your satisfaction is important to us. Review the following Terms and Conditions for Return to determine if your purchase can be returned or exchanged. If a product in your order does not fully meet your expectations and meets all of the conditions listed in these Terms and Conditions for Return, simply contact us via the contact information provided in the “Find Out More About These Terms and Conditions for Return” section, after having read these Terms and Conditions.

 

Returns and Exchanges

The return of returnable containers or pallets following the purchase of a product is your responsibility. The products, materials, tools, containers or pallets that may be returned and that were previously delivered by Du Chanvre shall have been maintained and returned in the condition of delivery or collection. Literary works and documents in hard copy or in PDF version do not require a return.

 

Terms and Conditions

You have 30 days after ordering to make a return or exchange provided the items have never been used. Shipping, handling and transaction fees shall apply for defective returns.

Du Chanvre cannot accept any errors from the client. It is the client’s responsibility to ensure the accuracy of the billing and delivery information, as well as to ensure that the item(s) ordered are compliant upon receipt.

If you receive a defective item, any complaint relating to a defective product should be sent to the address listed in the “Find Out More About This Policy” section, within TEN (10) days of receipt of the order by the client. The costs of returning goods are the responsibility of Du Chanvre, which shall allocate a full credit on the amount of the client’s invoice associated with a defective product(s). Only defective products may be exchanged upon presentation of proof of purchase, subject to inspection by our staff and provided that the defective product has not been used by the client.

If you order excess products, any complaint relating to an excess product shall be sent to the address listed in the “Find Out More About This Policy” section, within THIRTY (30) days of receipt of the order by the client. The costs of returning excess goods are the responsibility of the client, which shall be credited with the order, in addition to an amount equivalent to 25% which shall be retained by Du Chanvre for handling and administrative costs associated with an excess order.

 

Shipping of a Returned Product

To return a product, you must send it to the address on our website.

You shall be responsible for the full shipping costs to return your item and all costs associated with the return, including without limitation, delivery insurance and reshipment costs, if applicable. These charges are non-refundable, whether or not your return request is accepted, unless there is a defect.

Depending on where you live, the time it takes to receive your returned product may vary. It is your sole responsibility to ensure that the returned item reaches us at the address mentioned above within the prescribed time. We assume no responsibility with respect to your shipping of the item, including, without limitation, for any delay, as well as for any damage or loss that may arise in connection with the shipping of this item, including, without limitation, if the returned item is received damaged. If you are shipping an item with a value greater than $100, you should consider using a delivery service that allows you to track the shipment or purchase delivery insurance. We do not guarantee that we will receive your returned item.

 

Cancellation

If you need to cancel your order, it is important to notify us as soon as possible. It is possible to cancel an order before it is delivered if Du Chanvre has not yet started to make it. Certain transaction, handling and shipping charges may apply.

 

Refund Method 

Upon receipt of the duly returned merchandise, the verification of which confirms that the item complies with the Terms and Conditions of this Return Policy, Du Chanvre shall issue the credit, as the case may be. Credit will be allocated to the credit card or PayPal account originally used for your purchase. Please allow time for your refund to appear on your credit card statement or PayPal account.

If you have not received your refund, please check your bank account again. Next, contact the entity that issued your credit card, as there may be a delay before your refund is officially posted. Then contact your bank. There is often a processing time required before a refund is posted.

This Return Policy, as well as the use of the Site by the client, are governed by the laws of the province of Quebec and the laws of Canada applicable therein.

Welcome on Du Chanvre’s website and intranet (hereinafter referred to as: the “Site”). Du Chanvre assures you that the protection of your privacy and personal information is of the utmost importance. Your use of this Site is subject to applicable laws and to the terms and conditions appearing below, the whole being a legal agreement between you and Du Chanvre with respect to access and use of the Site (hereinafter: the “Terms and Conditions”). By accessing and using the Site, you accept all of the conditions set out below and you agree to abide by them without limitation or reservation.

 

Scope of Terms and Conditions

This Policy applies only to this Site. The Policy takes into account the requirements of the applicable laws of Quebec and Canada only.

The Site allows Du Chanvre to exhibit past achievements, as well as to list the products and services offered by Du Chanvre to its clients. The user of the Site acknowledges that he is responsible at all times for his use of the Site.

The Site and all of its content are the exclusive property of Du Chanvre, which manages them. In return for the express acceptance of these terms of use, and conditional on compliance with this agreement, Du Chanvre grants the user the right to browse the Site of Du Chanvre.

Du Chanvre remains, at all times, the sole and exclusive owner of the databases, programming codes or any other intellectual property related to the Site.

By using and browsing the Site and its content, you expressly accept these terms of use. If you do not agree to one or more of the terms set out herein, your only recourse is to stop using the Site.

By accepting this agreement, you certify that:

  • You have the legal capacity and the right to execute this agreement and to use the Site;
  • All personal information you have provided is accurate, updated and complete;

You acknowledge that by using the Site, you may not:

  • Forward any illegal or otherwise objectionable information of any kind;
  • Forward any message that discloses private or personal matters concerning a person;
  • Forward any information, file or software that contains a virus or any other contaminating or destructive item.

Du Chanvre reserves the right to investigate any alleged violation of the abovementioned conditions and to take legal action if necessary.

Du Chanvre reserves the right to terminate the Use Policy and your right to browse and use the Site or part of it, without notice, and at its sole discretion.

We take reasonable steps to ensure that your Personal Information is managed in accordance with the Privacy Policy, subject, however, to legal requirements applicable in certain countries other than Canada.

 

Intellectual Property

You acknowledge that the Products and Services and all information and documents found on the Site, including, without limiting the generality of the foregoing, software, images, texts, graphics, illustrations, logos, trademarks, copyright, photographs, videos and all related intellectual property rights (hereinafter the “Content”) are the exclusive property of Du Chanvre. You are therefore prohibited from copying, reproducing, modifying, reusing, transmitting, distributing or publishing elsewhere any Content of the Site or relating to the Services and Products of Du Chanvre without having obtained the prior written consent of Du Chanvre, which reserves all other rights relating to the Products and Services and the content of the Site.

You acknowledge that the use of the Products and Services is limited to your personal and non-commercial use only, unless you have obtained express written consent from Du Chanvre for another use.

Du Chanvre grants you a limited licence allowing you to display on your computer, mobile phone or tablet, to download and to use the Content only for non-commercial, personal or educational purposes, being understood that you shall not modify such Content and that you shall include with each copy of such Content, and display thereon, the corresponding copyright notice and this restricted licence.

The granted licence is limited. Consequently, you may not display, download, copy, reproduce, modify, adapt, translate, download, store, transmit, distribute, sell or use the Content of the Site for any other purpose than those mentioned herein, without Du Chanvre’s prior written consent.

You are also prohibited from carrying out “screen scraping,” “database scraping” or any other activity for the purpose of collecting, storing, manipulating or reorganizing data from the Site or any part of the Content, in any form or by any method.

Without limiting the generality of the foregoing, Du Chanvre owns all of the copyright to all Content displayed on the Site or has a licence to use it.

 

Content of the Site

You acknowledge that you are fully responsible for any content that you upload, post or email to Du Chanvre.

Except as otherwise expressed herein or in the Privacy Policy, any communication or content that you post or transmit to Du Chanvre by email or otherwise, including, without limitation, all entries into contests or sweepstakes, essays, questions, comments, suggestions or the like, is and will be treated as non-confidential and non-proprietary information and may be used by Du Chanvre and its suppliers (and their respective affiliates, agents or subcontractors) and other users for the purposes of, including, without limitation: reproduction, modification, disclosure, transmission, publication, broadcast and display of advertising or promotion in the media, known currently or subsequently designed or created, without further authorization, consent, payment or other consideration, unless prohibited by law.

You are responsible for the content of the information disclosed during the use of this Site, which information shall at no time be false, inaccurate or misleading, immoral or illegal.

Du Chanvre reserves the right to remove content when there is reason to believe that a user is violating these Terms of Use.

You acknowledge and agree that any content posted by users on Du Chanvre’s Site, such as comments, reviews, ratings, questions, reviews, blogs and other informational content is not endorsed by Du Chanvre and does not reflect the latter’s opinions. Du Chanvre disclaims all liability relating to the content published by users on its Site and may under no circumstances be held liable for damages of any kind whatsoever arising from the content published on its Site.

 

Limitation of Liability 

Although Du Chanvre takes the necessary measures to ensure the accuracy and reliability of the content of its Site, the latter is offered “as is” and “as available,” without any warranty or condition of any kind. Du Chanvre expressly excludes any representation or warranty that the Site is free from errors, viruses or other harmful items.

Without limiting the scope of the foregoing, Du Chanvre or its affiliates also disclaims any liability with respect to the following:

  • Errors or downtime of the Site (or servers) or which result from an interruption, a shutdown or a malfunction of the Internet or telecommunications services of a third party;
  • For any content posted by a user or third parties, including, without limitation, errors or omissions in such content, or for any loss or damage of any kind incurred as a result of the use of such content displayed, listed, emailed, transmitted or made available through the Site.

In the event that certain limitations mentioned above cannot be applied due to applicable laws, Du Chanvre’s liability towards the user for damages and claims of any kind whatsoever, shall be limited to the amount that the user has paid for the Products and Services.

Du Chanvre reserves the right, at its sole discretion, to modify, suspend, terminate or discontinue any aspect of the use of the Site at any time, including the availability of any functionality of the service or its content or to impose limits on certain features or certain aspects of the service or limit a user’s access to all or parts of the service, for any reason deemed reasonable by Du Chanvre, without notice, liability or obligation. Without limiting the generality of the foregoing, Du Chanvre may, at its sole discretion, limit access to the Site to any user that violates these Terms and Conditions.

These Terms or Use relating to the Products and Services on the Site constitute the entire agreement between the user and Du Chanvre.

The version of these Terms of Use, applicable to any transaction you have made on the Site, is the one in effect on the date and time you complete your transaction, as displayed on the Site at that time. Each time, you shall be deemed to have read and accepted the terms which govern this transaction, including these Terms and Conditions.

You may not assign or transfer in any way whatsoever this agreement and the rights or obligations arising from it to a third party without having obtained the prior written consent of Du Chanvre, which may, for its part, assign this agreement to a third party without your consent.

Privacy policy

Welcome to Du Chanvre’s website and its intranet (hereinafter referred to as: the “Site”). Du Chanvre assures you that the protection of your privacy and personal information is of the utmost importance. The Site shall therefore ensure the protection of the personal information it holds in accordance with the provisions of the Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1), such information being kept in compliance with the rules set by the law. The Site collects your Personal Information through forms found on the Site’s intranet.
